1.1 These Pay by Link Terms (the “Terms”) apply to any payment made to Acube Real Estate Development LLC (“Acube”, “we”, “us”) through a secure payment link issued by Acube or its authorized payment service provider (a “Payment Link”).
1.2 These Terms form part of Acube’s General Website Terms and Conditions, Privacy Policy and Cookie Policy. Where relevant, they also form part of the applicable Property Agreement, invoice, booking form or other transaction document. Capitalized terms not defined here have the meanings given in the General Website Terms and Conditions. If these Terms conflict with a Property Agreement, the Property Agreement prevails.
1.3 By making a payment through a Payment Link, you confirm that you have read and accepted these Terms.
2.1 A Payment Link may be used to pay booking or expression-of-interest amounts, reservation deposits, down payments, instalments, Dubai Land Department, Oqood, registration or administrative fees, and any other amount Acube requests in writing.
2.2 Each Payment Link is issued for a specific customer and transaction. It must not be shared with anyone else. It is valid for the period stated on it, or until it is used or cancelled, whichever comes first. Acube may cancel or replace the Payment Link at any time. Expired or cancelled links must not be used.
2.3 Despite clause 2.2, a Payment Link may be used by an approved third-party payer only where Acube has expressly authorised that arrangement and any required verification and compliance checks have been completed.
2.4 You are responsible for checking the amount, currency, reference and Property details before you pay. Acube is not responsible for errors in information you enter.
2.4 A payment does not by itself create, confirm or transfer any booking, reservation, sale or right in a property. Those matters are governed only by the Property Agreement and Applicable Law.
2.5 Receipt of funds does not constitute acceptance of an expression of interest, booking or reservation unless and until Acube issues the applicable written confirmation or the Property Agreement provides otherwise.
3.1 Genuine Payment Links are issued only through Acube’s authorised payment service provider, its official email domain (@acube.ae) and its official WhatsApp number published on the Website.
3.2 Acube will never:
(a) change its bank or payment details by email, WhatsApp or telephone alone; or
(b) ask for your full card number, CVV, PIN or one-time passcode through any channel.
3.3 Before paying, verify any unexpected payment request, or any request to change payment details, directly with Acube using the contact details on the Website. If you suspect a link is fraudulent, do not pay, and contact us immediately.
3.4 Acube is not liable for payments made through links or instructions it did not issue, except where the loss is caused by Acube’s own act or omission.
4.1 Available payment methods are those shown at checkout. Payments are processed in UAE Dirhams (AED) unless stated otherwise.
4.2 All currency conversion, foreign exchange, transaction limits and bank or card fees are set by your bank or card issuer and are your responsibility. The full invoiced amount must reach Acube, net of any such charges.
5.1 Payments must be made by the purchaser named in the Property Agreement or invoice, unless Acube agrees otherwise in writing.
5.2 Acube may require identification, authorization or source-of-funds evidence for any third-party payment, and may refuse or return that payment.
6.1 Payments are processed on the secure page of an authorized third-party payment service provider, which may require additional authentication such as 3-D Secure. Acube does not store full card numbers or CVV codes.
6.2 Third-party banks, gateways and card networks operate under their own terms and policies. Acube may share payment and transaction information with them as needed to process, verify or investigate a payment.
7.1 A payment counts as received only when cleared funds reach Acube or, where applicable, the designated project escrow account. A “successful” or “authorized” message from the payment provider is not confirmation of receipt.
7.2 Crediting may be delayed by banking, provider, card-network, holiday or technical processing. Contractual due dates and late-payment consequences under the Property Agreement continue to apply.
7.3 If less than the full amount due is received, the unpaid balance remains immediately due in accordance with the Property Agreement. Acceptance of a partial payment does not waive Acube’s rights in respect of the balance.
7.4 Unless the Property Agreement or Acube’s written payment instructions require otherwise, Acube may allocate a payment against any amount then due from the payer or purchaser in the manner Acube reasonably determines, subject to Applicable Law.
7.5 Acube will issue an official receipt or payment confirmation. Please keep it for your records. For off-plan Properties, funds will be credited to the project escrow account as required by Applicable Law.
8.1 If a payment is declined, fails or does not clear, the amount remains payable. Any temporary hold on your account is released under your bank’s procedures.
8.2 Acube may apply any duplicate or excess payment against other amounts you owe, or refund it, subject to the Property Agreement and Applicable Law.
9.1 Refunds are governed only by the Property Agreement and Applicable Law. Using a Payment Link creates no separate right to a refund.
9.2 Approved refunds will normally be made to the original payment method. Refunds of escrow funds are subject to escrow and regulatory approvals. Acube is not responsible for bank processing times, exchange-rate differences or bank charges on a refund.
10.1 You agree to raise any payment query or dispute with Acube first, before starting a chargeback.
10.2 If you start a chargeback on an amount validly due, Acube may treat that amount as unpaid, exercise all its rights under the Property Agreement, and recover any related fees and costs from you.
10.3 Recoverable costs may include reasonable payment-gateway, card-network, banking, administrative and legal costs, to the extent permitted by Applicable Law and the Property Agreement.
10.4 Acube may refuse, delay, suspend, return or reverse any payment that:
(a) is made in error, or is unauthorized or fraudulent;
(b) is inconsistent with the Property Agreement;
(c) requires investigation; or
(d) must be dealt with that way for legal, regulatory, sanctions, anti-money laundering or counter-terrorist financing reasons.
10.5 Acube may carry out identity verification, sanctions screening and source-of-funds checks at any time, before or after receiving a payment, and may request supporting documents for that purpose. Acube will not be liable for any delay or refusal resulting from these checks.
11.1 To the extent permitted by Applicable Law, Acube is not liable for any loss arising from:
(a) the acts, omissions, failure or unavailability of any bank, card issuer, gateway or payment network;
(b) processing delays outside Acube’s reasonable control;
(c) incorrect information entered by the payer; or
(d) payment instructions not issued by Acube.
11.2 Nothing in these Terms limits any liability or rights that cannot lawfully be limited, or any mandatory rights you have under Applicable Law.
12.1 Acube may update these Terms at any time. The version published on the Website at the time of payment applies.
12.2 These Terms are governed by the laws of the UAE as applied in the Emirate of Dubai. Subject to mandatory law and any different dispute-resolution clause in the Property Agreement, the courts of Dubai have jurisdiction.
